I just have a couple questions:
1. Is the work schedule supposed to be up 72 hours before the start of the next workweek?
-and-
2. Can an employer take away employees' eating priviledges?
I ask these questions because at the restaurant I work at, the schedule doesn't get put up until the day of the new workwook and it's my understanding (or so I've been told) that the schedule for the following week has to be up 72 hours in advance. If what I was told is true, then we've got some problems. (It's also a PITA!!)
Also, our eating privilidges were taken away over something stupid. It turned into a big fiasco and now when we have doubles to work, we have to leave to eat, which cuts into our workday.
All the employees that work there are now contemplating quitting just because it's turned into complete BS.
I should add that this restaurant is a single owned place- not a chain of any sort. It just seems like something illicit (illegal?) is going on. What does everyone think?

Fri, October 21, 2005 - 2:42 AMI know tht the schedule must be up BEFORE the new work week starts. As far as meals and such, I believe there is a lot of leniency in the law FOR the restaurant... i.e. they can do whatever as long as the employee gets 2 10 minute and one 30 minute break every 8 hours shift worked.. they do not have to provide the meal, and they can require you to be off premises for those said breaks... you are required to give an employee 10 minutes every 4 hours. If working anything over 10 hours, you are required to have one 60 min or 2 30 min, and from there we get into OT issues... in CA, it is OT after 40 hours, but depending where you are and who you work for you may get it after 8 hours (time 1/2) and after 12 hrs (double time)... blah blah blah...it can go on forever... Check out the labor boards website.. it may be different depending on the employer.

But how many of us have even been given more than a cigarettes worth of a break off the line?? Not many, unless you're union.

Tue, October 25, 2005 - 11:09 AMI have never taken a break anywhere I have worked...except in a hospital, and they make sure EVERYONE gets their breaks and lunches by the book. They schedule it like that. At my last job, where I was the mgr of a large crew, I had to schedule the breaks and lunches cos they would work thru it everytime and end up costing the co. $$$ in OT. LOL. I didnt care as long as the work got done and doen right. I dont know how many times I got my ass reamed for letting my crew work unapproved OT. I don't like breaks and will work 12 hours non stop and then think "jeeze where did the time go?" Love that shit!
